Comments: Dear Mr. and Mrs. Pena, I am a sophomore at Sam Houston State University in Texas. I was given an assignment in my english class to write a problem/solution essay. I was almost side swiped by a driver on a cell phone so I decided to make my topic over cell phone safety in cars As I researched my topic I became aware of how big the problem is. I absolutely agree with the need of state-wide education and awareness of this problem. I also would like to see a ban of cellular phones in moving vehicles. Along with my essay, I had to give a five minute presentation. I printed out the two flyers from your website to distribute to my class. I believe your fight has brought the attention to many people about the uses of cell phones while driving. I am not a cell phone user. I take public transportation everday. As I wait at the bus stop, most times I see accidents waiting to happen because of careless users. The statistics (which are very few and out dated) states, the majority of accidents lie between the ages of 20 - 26. In addition, most are college students and working professionals. I am curious if you have head any updates on the legislation for New York with regards to banning the use of cell phones while driving. The other day I observed a woman making a left-hand turn in a busy intersection...in her right hand she had a LIT CIGARETTE and THE STEERING WHEEL...in her left hand she had a CELL PHONE HELD TO HER EAR! Tell me she was following the suggestion in the PA Driver's Manual on page 36 (Pub. 95/3-99) where it states twice that, "You must be alert when turning." Comments: I'm so sorry for your loss. My 2yr old son Anthony was struck by a car and killed June 10. The driver had a cell phone, I asked the police if she was on it, she told them no. They never checked into it until I went to the DA office and brought this up b cause all the officers there weren't aware of the phone. I'm still waiting for the statment to come. I would receive pages that would need to be returned within 20 minutes,so as a RN in the field using the cell phone while driving wa like breathing. Comments: I completely agree with you. I see people talking on their phones in cars and not paying any attention to what is going on around them. If someone needs to use their phone, they can pull over and talk, instead of endangering their own lives and the live of others. It's especially a problem with driving automatic cars...which you can drive with one hand, and as my mother says, "put your car in drive and your mind in neutral." I am interested to know more about the availability of public pay phones in PA. Isn't that where you are from. Here in Chicago there are not many phnes availble- business people must rely on cell phones at certain times. I am a small busienss owner, and run operations myself- I find it absolutely necessary at certain times to receive calls when driving- do I pull over asap? Yes- Do i inform the person I'm talking to that I'm driving - yes- I have made a copy of "Morgans Tips" and when I am finished reading all this info, and after the show Wed. I will AT LEAST assist in raising awareness by producing a flyer regarding cell phone safety and distibuting it with paychecks to staff. This issue requires soem thought, and as I said, its come to my immediate attention just yesterday. I know the value of awareness through education and training, its slow but it works. I have been an "alcohol awarenss trainer" with the TIPS Program for over 12 years, and have taught bartenders and servers of alcohol about dangers of drunk driving. I h ve seen the attitudes change. Again, watching late night TV I spotted Patti in front of some panel in government stating her case for the laws. If it was not for Patti and Rob's public appearances about their tradegy, I would not be so aware of the danger and now also in a position to make others aware. I am a on the road sales rep who uses a cell phone 90% of my day. i can't tell you how many "close" instances i have had over the years. Since hearing your story, I have really began to think about how fragile life is and how quick we can lose it. I give the munchkins a little longer hug in the morning before I leave now. I average 3k mile a month and I am proud to say my cell use w ile steering the car has dropped over 70% since i first heard this story. No not 100% and surely not perfect, but I would strongly support legislation you are aiming for. Here in Austria it was made mandatory (I believe as of July,1999) that cell-phones in cars be used only "hand-free". Unfortunately, that still has not changed many people's habits. I purchased a new digital cell phone with caller ID which means I can ignore calls when I have to pay attention to the road, and still get in touch with the person tr ing to contact me. Comments: I wrote yesterday but had to write again...if there is anything I can do let me know because I am appauld that the accident that occured at that intersection just a few weeks after Morgan's was also caused by cell phone use but the papers and all but one v channel neglegted to let that be known. People can not (even if they say they can just like a person who is drunk does) drive a car safely at the same time! If they started covering more of the accidents that were cell phone related I think people would get the point. I was mad to see again in the paper that people are willing to say don't because I can do it safely! This has got to end!!

Comments: This not being a law is terrible. I know we must of almost got hit so many times due to people failing their responsibilties behind the wheel. My class and i were writing to different legislatures to tell what we want to happen in our city or town. I wrot to Gov. Comments: 1) Most states had (many still have) laws on the books that forbid even using a CB radio while moving. They are largely ignored, but the laws might be re-enforceable. Cell phones are a radio device. 2) AT LEAST there should be a requirement to use a "hands-free" setup in the car. This is readily available and cheap technology. 3) People don't take driving seriously enough as it is. Now they even use excuses, "Well, I was busy on the phone!" Unacceptable. Lives are at stake here.

I have always been baffled how the cell phone slipped through legislation while the use of headphones while driving, in the recent past, was banned in many states. And that was more of a 'background noise' that distacted the driver. Cell phones bring on more of a distracting note because the driver would need to concentrate on what the voice on the other end is saying and respond in kind.
